Terms of Service

1. Eligibility

To use Synthia, you must:

• Be at least 13 years of age.
• Have the legal capacity to enter into a binding agreement in your jurisdiction.
• Not be barred from using our services under applicable laws.

By using the App, you confirm that you meet all eligibility requirements. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

2. Account Creation and Responsibility

To access certain features, you must register an account. You agree to:

• Provide true, accurate, and complete information
• Keep your login credentials confidential
• Immediately notify us of any unauthorized access

You are responsible for all activities that occur under your account. We are not liable for any loss or damage resulting from unauthorized use of your account.

3. Services Provided

Synthia allows users to:

• Generate AI-powered videos, including:

  • Soundless videos via Synthia AI
  • High-quality, sound-enabled videos via Veo 3
• Use a JSON-formatted prompt generator
• Upload text, images, or video input as part of prompt content

We may add, remove, or modify features without prior notice.

4. Token-Based Monetization

The App uses a token system for access to features.

• Tokens are purchased exclusively via in-app purchases (Google/Apple).
• Prices are displayed within the App and are subject to applicable taxes.
• There are no refunds, including for unused tokens, accidental purchases, or dissatisfaction.
• Token purchases are final unless required by law.

5. User-Generated Content

You retain full ownership of any content you generate. You grant Sunkiss AI a non-exclusive, royalty-free, worldwide license to store and display your content within your account. You acknowledge:

• You are solely responsible for your generated content.
• You must not generate content that is unlawful, obscene, hateful, defamatory, infringing, or otherwise harmful.
• You may freely use, download, share, or distribute content you create.

We reserve the right (but not the obligation) to review and remove content that violates these Terms or is reported by other users.

6. Use of Third-Party AI Systems

Synthia integrates with:

• Google's Gemini platform for use of the Veo 3 video generation model

While we strive to offer high-quality outputs, we make no guarantees about:

• Accuracy, relevance, or truthfulness of generated content
• Copyright safety or originality
• Absence of potentially harmful, biased, or offensive material

Use AI results at your own discretion. You agree not to hold Sunkiss AI liable for any damages, legal claims, or reputational harm resulting from content produced by AI systems.

7. Storage and Data Retention

• All prompts and generated videos are stored on our servers.
• Users may delete any generated content from their account.
• Deleted content will be removed from user access and scheduled for purge from our systems unless we are required to retain it (e.g., for abuse investigations or legal compliance).

8. Acceptable Use Policy

You agree not to:

• Violate any laws, including privacy, copyright, or intellectual property laws
• Use the App for generating illegal, violent, or NSFW content
• Use automated tools (bots, scripts, scrapers) to access or interact with the App
• Introduce malware or harm to our systems
• Interfere with the integrity, performance, or availability of the App

Violations may result in account suspension, content removal, and/or legal action.

9. Termination

We may suspend or terminate your account:

• If you breach these Terms
• For fraudulent, abusive, or harmful behavior
• Upon lawful request by authorities

Upon termination:

• Your right to access the App ends immediately
• Stored data may be deleted unless legally required to retain it

10. Disclaimers

• Synthia is provided "as is" and "as available."
• We make no warranties or guarantees (express or implied) about reliability, uptime, accuracy, or fitness for a specific purpose
• We do not warrant that the App is free from errors, malware, or defects
• Use of AI tools carries inherent risks and you agree to assume full responsibility for the use of content generated within the App.

11. Limitation of Liability

To the maximum extent permitted by law:

• Sunkiss AI is not liable for any indirect, incidental, special, punitive, or consequential damages
• Our total liability shall not exceed the total amount paid by you (if any) in the 3 months prior to the claim
• Some jurisdictions may not allow these limitations; if so, they apply to the fullest extent allowed.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sunkiss AI and its affiliates from any claims, liabilities, damages, and legal fees arising out of:

• Your use or misuse of the App
• Your violation of these Terms
• Content you generate or share

13. App Store Terms

This agreement is between you and Sunkiss AI, not Apple or Google. You acknowledge:

• App Store providers are third-party beneficiaries
• Apple/Google are not responsible for support, maintenance, or claims

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Canada. Any disputes must first be resolved through informal negotiation. If unresolved, the matter shall be brought before the appropriate courts in Canada.

15. Changes to the Terms

We may revise these Terms at any time. When changes are made, the "Effective Date" at the top will be updated. You are responsible for reviewing updated Terms. Continued use of the App signifies your acceptance.
